This policy explains what personal data our website collects, why, and what you can do about it. It covers effectivemarketer.com, the free website check, reservations, the emails we send to businesses, and the calls that follow. Work for clients is covered by each client's own agreement.

The short version

  • No cookies, no analytics and no ad trackers.
  • We collect only what you give us, plus the basic logs every website keeps.
  • We use it to run your free check, hold your reservation and reply to you.
  • If we emailed you first, we found your work contact details in public business sources. Reply "unsubscribe" and we stop.
  • We never sell your data, and we keep what you check and reserve confidential.
  • You can see, correct or delete your data whenever you like.

Who we are

Effective Marketer LLC runs this website. We decide how the personal data collected here is used, which makes us its controller under EU and UK data protection law. Reach us at contact@effectivemarketer.com.

What we collect and why

You can read the whole site without telling us anything. We only need your contact details if you reserve spots or book a call. For each use, we give the legal basis under EU and UK law.

When you check your website

You type a website address and press "Check my website". The address travels in the page link, like effectivemarketer.com/your-spots/?site=yourstore.com. The check uses it to look up the searches people type for that website and show which spots are free or taken. A website address usually points to a business rather than a person, but we treat it with the same care.

Legal basis: our legitimate interest in giving you the free check you asked for.

When you reserve spots

You enter your name, email address and WhatsApp number. We keep them with your website and the searches you picked, so we can hold those searches for you, send you the details and follow up about your reservation. We use your WhatsApp number only to contact you about your reservation and your call. Until you book your call, we send you a few reminder emails about your reservation, and each one has a link to stop them.

Legal basis: steps you ask us to take before a possible agreement.

When you book a call

Our booking calendar runs on cal.com, which collects your name, email address, the time you pick and anything you add. We use this, and what you tell us on the call, to run the call and to prepare a proposal if you'd like one.

Legal basis: steps you ask us to take before a possible agreement.

When you email us

We receive your name, email address and message, and use them to reply and keep a record of our conversation.

Legal basis: our legitimate interest in answering you, or steps you ask us to take before a possible agreement.

When we email you first

Most people find us because we emailed them about their business. For that, we use work contact details (your name, work email address, company, role and website) that we find in public business sources, such as company websites and professional profiles, or get from B2B lead-data providers. We use them to send you a few emails about our service, and to reply if you answer.

Don't want to hear from us? Reply "unsubscribe" or email us, and we'll stop and remove you. We keep only what we need to make sure we don't email you again.

Legal basis: our legitimate interest in offering our service to businesses. You can object at any time, and we'll stop.

Every time you visit

Like every website, ours runs on servers that record basic details of each visit: your IP address, browser and device type, the page requested (including any website address in its link) and the time. We use them to run the site, keep it secure and fix problems.

Legal basis: our legitimate interest in a safe, working website.

Where we rely on legitimate interests, we've balanced them against your rights, and you can object at any time.

Cookies and tracking

Our website doesn't use cookies, analytics or advertising trackers. Our fonts and files load from our own site, so our pages don't contact Google or any other outside service while you browse.

Who we share it with

We use a few providers, and each gets only what it needs to do its job for us:

  • Our search-data provider receives the website address you check (never your email) and sends back the search data.
  • Our scheduling provider runs our booking calendar. Its own privacy policy also applies when you use its pages.
  • Our hosting provider, Hetzner Online GmbH, runs the website on its servers and keeps its server logs.
  • Our email-sending platform sends our emails to businesses and records whether they were delivered or answered. It may also record when an email is opened or a link in it is clicked.
  • Our email provider carries and stores our email.

We may also disclose data when the law requires it, to protect our rights or someone's safety, to our professional advisers, or to a buyer if our business changes hands.

We never sell your personal data. What you check and reserve stays confidential. Other visitors only see that a search is taken, never who reserved it, and our clients' campaigns and strategies are never shown to anyone.

International transfers

Our team works from the US, France, Vietnam and Bulgaria, and some of our providers are based in the US. So your data may be accessed from outside the European Economic Area (EEA) and the UK, including from countries the EU and UK haven't recognized as protecting data to their standard. When that happens, we use the safeguards the law provides, such as the European Commission's Standard Contractual Clauses (with the UK Addendum), or the EU-U.S. Data Privacy Framework and its UK Extension where a provider is certified. Email us for a copy.

How long we keep it

  • Server logs: 30 days.
  • Reservations, call bookings and emails that don't lead to an agreement: 12 months after our last contact, then we delete them.
  • Business contact details we found for our emails: 12 months after our last email, unless you become a client. If you ask us to stop, we keep only your email address on our do-not-contact list.
  • If you become a client: what our work together and the law require.

You can ask us to delete your data sooner, and we will, unless the law requires us to keep it.

Your rights in the EU and UK

If you're in the EU, the EEA or the UK, you can ask us to:

  • give you a copy of your personal data;
  • correct anything that's wrong;
  • delete it;
  • limit how we use it, or stop using it, including for follow-up emails;
  • send it to you or to another company in a common format.

Email contact@effectivemarketer.com. It's free, and we'll reply within one month. We may ask you to confirm who you are first.

If you're unhappy with how we've handled your data, you can complain to the data protection authority where you live or work (in the UK, the Information Commissioner's Office). We'd appreciate the chance to put it right first.

Your rights in the US

California and several other US states give residents rights over their personal information. We honor these requests from anyone in the US: to know what personal information we hold about you and get a copy, to correct it and to delete it.

What we collect falls into four categories: identifiers (such as your email and IP address), internet activity (our server logs), professional information (such as your company and role) and business details you share with us. We don't sell or share personal information as California law defines those terms, we don't use it for targeted advertising, and we don't ask for sensitive personal information.

To make a request, email us. We'll confirm it's you, and an authorized agent can ask on your behalf. We'll never treat you differently for using your rights. If we turn down a request, you can appeal by replying to our answer, then contact your state attorney general if you're still not satisfied.

Children

Our site is for businesses and isn't meant for children. We don't knowingly collect data from anyone under 16. If you think a child has sent us personal data, email us and we'll delete it.

Security

We protect your data with sensible safeguards, such as encrypted connections, access only for the people who need it, and providers we trust. No website can promise perfect security, but if a breach puts your data at risk, we'll tell you and the authorities as the law requires.

Changes to this policy

We'll update this policy when our website or practices change, and change the date at the top. If a change affects how we use your data, we'll say so clearly on this page.
